Planning Enforcement

Providing clarity and practical solutions to regularise unauthorised developments and activities in response to Enforcement proceedings taken by the planning authorities.

Planning enforcement is a statutory and legal procedure initiated by local government under the Planning Acts for non-compliance with planning legislation.  Planning enforcement can arise from several and multiple actions including; a breech of planning permission, non-compliance with planning conditions; and as a result of partially completed developments.  In all cases, it requires careful and measured redress to ensure compliance with the planning code and to avoid costly legal/court actions.

Our planning enforcement services are sought by those served with or seeking assistance in response to Enforcement Notices and Warning Letters including developers, receivers and restructuring interests and provide for;

  • Expert advise to review, confirm and advise on the alleged planning breeches and provision of practical remedial solutions;
  • Professional and formal representations to local authorities on planning enforcement matters;
  • Professional assistance to legal professions on planning enforcement issues including oral and written planning opinion, interpretation and solutions.
