Planning Legislation and Covid-19

Time scales relating to Planning matters, provided for under the Planning and Development Act 2000 (as amended), are likely to affected by the enactment of draft legislation in response to the current National health emergency.

 

The current Bill provides that the ‘appropriate period and time limits’ under the Planning and Development Act 2000  is to be disregarded for a defined period of time which is likely to commence upon enactment of that Bill, for a period yet to be determined by Government but not later than November 9th 2020.

 

In effect, it is understood that whilst planning applications can continue to be made during this period of the ‘emergency’, no decisions will be made by a Planning Authority or An Bord Pleanála as the period of public consultation will remain open during that period.  This is likely to relate to appeal and legal timescales also.  Where the public consultation period has closed or there is no requirement for public consultation, then it is understood that decisions may be made by a Planning Authority or the appeals Board.  Full details will be known upon passing of that Bill.
