September 2020. The High Court quashed An Bord Pleanála decision in respect to an application for strategic housing development (SHD).
On instruction from Orphen Franks Solicitors, HRA PLANNING was tasked to review the case and presented the technical grounds which formed the primary and successful grounds of judicial challenge – that there had been failure to give reasons in the planning decision to permit a breach of the building height limits set out in the Dublin City Development Plan.
This case demonstrates the complexity of the ‘Strategic Housing Development’ provisions and the experience of HRA PLANNING in the planning application and consents process.
