Development Contributions – HRA bringing added value

HRA PLANNING have successfuly secured the removal of a €70,000 development contribution from a planning permission through the planning appeals process.

The Special Development Contribution levied under the Planning and Development Act was applied by a Local Authority to a commercial quarry development earlier this year.   The attachement of the Development Contribution to the planning permission was challeneged by HRA PLANNING on appeal to An Bord Pleanála who agreed with and accepted the material arguments presented in the appeal.   On the basis of the appeal, the planning condition setting out the requirement on the  applicant to pay the €70,000 to the Local Authority was completely removed from the permission by An Bord Pleanála in October 2013.

The determination of this case was made despite the same development contribution being applied to other quarry developments by the same local authority and which were accepted by other quarry operators.
